1. Acceptance

By accessing or using HeadFade (headfade.com), you agree to be bound by these Terms of Service. If you do not agree, do not use our services. You must be at least 13 years old (16 in the EU).

2. Account Responsibilities

• You are responsible for maintaining the security of your account
• You are responsible for all activities under your account
• Report unauthorized access immediately to security@shadowtagai.com

3. Acceptable Use

You agree not to:

• Upload content you do not own or have rights to
• Attempt to access other users' data or accounts
• Circumvent security measures or rate limits
• Use automated tools to scrape or abuse our APIs
• Upload malicious code or harmful content
• Use our services for any illegal purpose

4. AI-Powered Features

HeadFade uses Google Gemini and Vertex AI for video analysis. AI outputs (HDI scores, deepfake detection, forensic reports) are informational only and do not constitute professional forensic, legal, or expert advice. AI results are probabilistic and may contain errors. You should independently verify AI outputs before relying on them for critical decisions.

5. Your Content

You retain ownership of content you upload. You grant us a limited license to process, store, and analyze your content solely for service delivery. We do not claim ownership of your uploads.

6. Payment

Paid features are billed via Stripe. Subscriptions auto-renew unless cancelled. Refunds are handled case-by-case within 30 days. We reserve the right to change pricing with 30 days' notice.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: Our total liability is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, loss of data, revenue, or business opportunities, or the accuracy of AI-generated outputs.

8. Dispute Resolution

These Terms are governed by Delaware law, USA. Disputes shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration under AAA Commercial Arbitration Rules.

9. Termination

You may terminate your account at any time. We may suspend your account for Terms violations with notice when practicable. Upon termination, your data is deleted per our Privacy Policy.
